1. Introduction

These Terms and Conditions ("Terms") govern your use of the Meme Moda website at mememoda.com ("Site") and any purchases you make from us. By accessing the Site or placing an order, you agree to these Terms in full.

Meme Moda is operated by Meme Moda SL, a company registered in Spain. Our registered address is Madrid, Spain. VAT: ES-PENDING.

2. Ordering

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order. Your order is accepted when we send you an order confirmation email. If we are unable to fulfil your order (e.g. due to a stock error), we will notify you and provide a full refund.

All prices are displayed in Euros (€) and are inclusive of applicable VAT. Prices may change at any time without notice, but changes will not affect orders already accepted.

3. Payment

We accept Visa, Mastercard, American Express, Apple Pay, and Google Pay. Payment is processed securely by Stripe Inc. By providing payment information, you confirm that you are authorised to use the payment method and that the information provided is accurate.

4. Shipping

We aim to dispatch orders within 1–2 business days. Delivery timelines are estimates and may be affected by factors outside our control (customs, carrier delays, etc.). Risk passes to you when we hand your order to the carrier. For international orders, you are responsible for any import duties or taxes levied by your country.

5. Returns & Refunds

Under EU consumer law, you have the right to cancel any order within 14 days of receipt without giving a reason ("cooling-off period"). We voluntarily extend this to 30 days. Items must be returned in original, unworn condition with all tags attached. Refunds are issued to the original payment method within 5 business days of receiving your return.

Items marked Final Sale and hygiene items (swimwear, underwear) are excluded from returns unless defective.

6. Defective or Incorrect Products

If you receive a defective or incorrect product, contact us within 48 hours at [email protected] with your order number and photographs. We will arrange a free return and replacement or full refund at our cost.

7. Intellectual Property

All content on the Site — including text, images, logos, designs, and code — is owned by Meme Moda SL or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute, or use our content without prior written consent.

8. User Conduct

You agree not to use the Site for any unlawful purpose, to transmit any harmful or offensive content, or to attempt to gain unauthorised access to any part of the Site or its systems.

9. Limitation of Liability

To the maximum extent permitted by law, Meme Moda shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or products. Our total liability shall not exceed the value of the order giving rise to the claim.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other matter where exclusion is prohibited by law.

10. Governing Law

These Terms are governed by Spanish law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain, without prejudice to your rights as a consumer under the law of your country of residence within the EU.

11. Changes to These Terms

We may update these Terms from time to time. The current version is always published on this page with the date at the top. Continued use of the Site after changes constitutes acceptance of the updated Terms.
